USA Today reports “cannabidiol or CBD has been showing up in a widening array of goods” after 2018 legislation determined hemp, from which CBD can be sourced, “was not an illegal controlled substance,” and as a result “employers are now grappling with” both “CBD use by their employees” and “the rising legalization of recreational and medical marijuana.” Only one hemp-derived CBD medication has received FDA approval, and while “a certain amount of THC is allowed in CBD products as long as it doesn’t exceed” state or federal limits, that quantity “could still trigger positive results on a drug test, which an employer may say is unacceptable.” Guidance on the FDA’s website says, “In addition to safety risks and unproven claims, the quality of many CBD products may also be in question,” as “many were found to not contain the levels of CBD they claimed.”
